Mega Raffle on CES Connect App 2024

Sponsor/Administrator: City Electric Supply Company (“CES”)

Promoting Office: 400 S. Record Street, Suite 400, Dallas, Texas 75202

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

1. Introduction

By participating in this raffle, you agree to comply with and be bound by the following terms and conditions.

2. Raffle Schedule

• Opening Time: The Mega Raffle opens on Sunday, June 30 at 6:00 a.m. on the CES Connect 2024 App.
• Point Accumulation Deadline: No more points can be earned after the raffle opens. Any steps or activities completed will not be tracked or counted toward your total points after this time.
• Entry Submission Deadline: Entries for desired items must be submitted by Sunday, June 30 at 11:59 p.m.
• Winner Announcement: The raffle will take place on Monday, and winners will be notified via the CES Connect 2024 App.

3. Eligibility

To be eligible to participate in the Mega Raffle, individuals must be at least 21 years of age at the time of entry and be registered attendees of CES Connect 2024. Any entries submitted by individuals who do not meet these eligibility criteria will be disqualified. Participation in the Mega Raffle constitutes each entrant’s full and unconditional agreement to these Terms and Conditions. Proof of age and attendance may be required to verify eligibility before any prize is awarded.

4. Earning Points

Points can be earned through the following activities:

• Counting Steps: Track your daily steps using the CES Connect 2024 App.
• Scavenger Hunt: Participate in the scavenger hunt events.
• Social Sharing: Share photos and videos on the social feed within the App.
• Daily App Usage: Use the CES Connect 2024 App daily to earn points.
• Vendor QR Codes: Scan QR codes from participating vendors.
• Backpack Filling: Fill backpacks for kids in need.
• Sweepstakes: Enter the CES Cares sweepstakes to earn additional points.

5. Participation

• Participants must use the points accumulated over the weekend to submit their entries for the items they desire.
• Entries must be submitted via the CES Connect 2024 App before the entry submission deadline.
• Multiple entries are allowed and are limited only by the entrant’s available points.

6. Winner Selection and Notification

• Winners will be selected randomly from the pool of valid entries for each item.
• Winners will be notified via the CES Connect 2024 App on Monday, July 1, following the raffle.

7. General Conditions

CES reserves the right to disqualify any participant who tampers with the entry process or violates these official rules. CES is not responsible for any technical issues or failures that may affect participation or entry submission. All decisions made by CES regarding the raffle are final and binding.

To the fullest extent permitted by law, neither CES, nor Apple Inc., nor Google LLC, nor any of their respective officers, directors, employees, representatives, affiliates, or agents, shall be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or connected to your participation in the Mega Raffle. This includes, but is not limited to, the acceptance, possession, use, or misuse of any prize awarded, any technical errors, such as errors in computing any raffle points, errors in notification of winners, delays or failures arising from any electronic or mechanical equipment malfunctions, defects, or failures, or any other errors of any kind, whether human, mechanical, electronic, or network.

Participants agree to release, discharge, and hold harmless CES from and against any claims, damages, disabilities, attorneys’ fees, and costs of litigation and settlement, as well as any liability due to any injuries, losses, or damages of any kind to person(s), including death, or property damage resulting, in whole or in part, directly or indirectly, from acceptance, possession, misuse, or use of any prize or participation in any raffle-related activity or participation in this Mega Raffle. This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages; loss of data, income, or profit; loss or damage to property; and claims of third parties.

Notwithstanding the foregoing, in the event that the foregoing limitation of liability is determined by a court of competent jurisdiction to be invalid or unenforceable, participants agree that CES’s liability shall be limited to the cost of entering and participating in the Raffle.

Participants further agree that CES’s liability shall be limited to the greatest extent permitted by law and that the provisions of this limitation of liability will continue in full force and effect notwithstanding any termination or cancellation of the raffle or your discontinuation of participation in the Raffle.

8. Privacy

By participating in the Mega Raffle, each participant grants CES a non-exclusive, transferable, perpetual, irrevocable, and fully paid-up license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display any content, materials, or information (including, but not limited to, ideas for new or improved products and services) submitted by the participant to the raffle (collectively, “Submissions”). This includes any photographs, writings, drawings, videos, or any other media or intellectual property submitted as part of participation in the Raffle.

CES shall have the unrestricted right to use any and all Submissions, whether for advertising, marketing, promotion, research, or any other lawful purpose, without compensation to the participant, acknowledgment or approval from the participant, and without limitation as to duration or frequency. This grant includes the right to make any public or private statements about the Submissions and their originality and appropriateness in any manner or context, without notice or compensation to the participant of any kind.

Participants acknowledge and agree that CES is not obligated to use any Submission but may do so at its discretion. Furthermore, by participating in the Mega Raffle, each participant warrants that their Submissions are their original work, do not infringe the intellectual property rights of any third party, comply with all applicable laws and regulations, and do not contain any material or information that is defamatory, libelous, unlawfully threatening, or unlawfully harassing.

9. Non-Affiliation

The Mega Raffle is solely organized and sponsored by CES, an independent entity. It is not in any way sponsored, endorsed, administered by, or associated with Apple Inc., Google LLC, or any of their affiliates or subsidiaries. CES is solely responsible for all aspects of the raffle, including prize fulfillment and the management of entries. Apple Inc. and Google LLC are not affiliated with this promotion in any manner, nor do they bear any responsibility or liability for any part of it. No other partnerships or affiliations with any other company are implied or should be inferred herefrom.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. The parties hereby expressly consent to and agree to submit to the exclusive jurisdiction of and venue within the state and federal courts located within Dallas, Texas for all matters arising out of or related to this Agreement or the participant’s involvement in the Mega Raffle. Each party waives any objection it may now or hereafter have to the venue of any such action or proceeding, and irrevocably consents to the jurisdiction of such courts in any such action or proceeding.
