“Official Rules”

Sponsor/Administrator: 

City Electric Supply Company (“CES”)

Eligibility:

Only CES connect attendees are eligible to win. Vendors are not eligible. The promotion is open only to individuals who are at least twenty-one (21) years old at the time of participation.  Participation in this promotion constitutes your full and unconditional agreement to abide by these terms and conditions.

BIDDING REQUIRED. A BID OR PAYMENT OF A MINIMUM OF $75 IS REQUIRED TO PARTICIPATE. VOID WHERE PROHIBITED.

Promotion Benefitting Make-A-Wish®:

100% of funds collected in connection with this promotion will benefit the Make-A-Wish Foundation of America (“MAWFA”). Written information about MAWFA is available by calling 1-800-722-9474, or by visiting MAWFA’s website at wish.org.

Promotion Schedule:

Saturday, June 29^th at CES Connect (all times are Central Daylight Time)

Start Time: The Whiskey Promotion begins at 9:00 a.m. at the CES Cares Booth.

Bid Closing Time: All bids must be submitted by 2:45 p.m.

Payment Deadline Period: From 3:00 p.m. – 5:00 p.m. The top 200 bidders must pay their final bid amounts. All final payments must be made by 5:00 p.m.

CES reserves the right to disqualify participants if final bid amounts are not timely paid.

                  Whiskey Experience Drawing: The drawing will take place at the Awards Show.

Prizes:

Custom Whiskey Bottle: Limited edition whiskey bottle, selected by the Whiskey Experience Winner, with Make-A-Wish® and CES brands on the bottle.

Whiskey Experience: Jack Daniels Distillery tours. Whiskey Experience prize includes flight and hotel accommodations, a personal tour of the distillery, a tasing experience, and the opportunity to choose the whiskey “barrel” for the 200 Custom Whiskey Bottles to be awarded to the Whiskey Bottle Winners.

Winners:

Whiskey Bottle Winners: Two hundred (200) individuals will each be awarded one (1) Custom Whiskey Bottle. The winners will be determined based on (i) the 200 highest bids, (ii) if there are duplicate bids among the 200 highest bidding individuals, then the selection will be made based on the earliest to bid, (iii) and the timely completion of payment of final bid amount.

Whiskey Experience Winner: one (1) individual will be awarded the Whiskey Experience. Upon timely final payment of the full bid amount, each of the Whiskey Bottle Winners will become eligible to be entered to win the Whiskey Experience Raffle. Whiskey Bottle Winners will receive a designated number of entries for the Whiskey Experience based on the position of their bid (i.e., the 1^st highest bidding Whiskey Bottle Winner will receive 200 entries, the 2^nd highest bidding Whiskey Bottle Winner will receive 199 entries, and so on until the 200^th highest bidding Whiskey Bottle Winner receives 1 entry). Bid position is determined by 1) the bid amount and 2) in the case of bids in the same amount, the time each bid is placed.

Participation:

Bidding Process:

• • Use the CES Connect app to place your bid by following the prompts under “Live Events.”
  • The minimum starting bid is $75.
  • Upon inputting your payment information and placing an initial bid, a temporary authorization will be placed on your card in the amount of $75 (irrespective of the amount of your initial bid). Your card won’t be charged unless you are in the top 200 at the auction’s end.
  • You may view the status of your bid in relation to other participants and can increase your bid amount through the app at any time prior to Bid Closing Time at 2:45 p.m. If you are within the top 200 at auction close, your card will be charged $75 (the amount of the initial minimum bid).
  • IF YOUR BID EXCEEDS $75, YOU WILL THEN NEED TO LOG BACK INTO THE APP, BETWEEN 3:00 AND 5:00 P.M., AND PAY THE DIFFERENCE BETWEEN YOUR BID AND THE MINIMUM BID AMOUNT. FAILURE TO LOG BACK IN AND PAY ANY SUCH DIFFERENCE WILL RESULT IN YOUR BID BEING VOIDED.
    • Note that duplicate bids (i.e., competing bids of the same amount) will be awarded to the earliest bidder.
  • Finalizing Bids: The top 200 bidders must pay any remaining amount owed in excess of $75 by 5:00 p.m. to be eligible for the Whiskey Experience Raffle.
    • Please note that your bid is not finalized until full payment is made of your final bid amount during the Payment Deadline Period (from 3:00 p.m. – 5:00 p.m.). This additional action is required to ensure your full eligibility.

Winner Selection and Notification:

• Whiskey Bottle Winners will be notified following the conclusion of the promotion and will receive additional communication regarding the status of their prize from CES Marketing. Please note that the timing of receipt of Custom Whiskey Bottle is dependent on Whiskey Experience Winner’s selection, therefore CES is unable to provide an estimated delivery date.
• Whiskey Experience Raffle: A drawing from amongst the Whiskey Bottle Winners will be held and announced during the Awards Show. The one (1) winner will be selected at random.

General Conditions:

• The organizer reserves the right to disqualify any participant who tampers with the entry process or violates these terms and conditions. CES reserves the right, in its sole discretion, to verify any element of any entry or related materials, request additional information and to disqualify any participant whose participation may violate these terms and conditions or subject CES or CES’s Customers to controversy, negative publicity, scorn, ridicule or other concerns. CES reserves the right to change the terms and conditions, modify or end the promotion at any time without notice.

• CES is not responsible for internet, telephone, or other communication problems of any kind. All decisions made by CES regarding the auction are final and binding.

• To the fullest extent permitted by law, neither CES, nor Apple Inc., nor Google LLC, nor any of their respective officers, directors, employees, representatives, affiliates, or agents, shall be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or connected to your participation in this promotion. This includes, but is not limited to, the acceptance, possession, use, or misuse of any prize awarded, any technical errors, such as errors in computing, errors in notification of winners, delays or failures arising from any electronic or mechanical equipment malfunctions, defects, or failures, or any other errors of any kind, whether human, mechanical, electronic, or network.

• Participants agree to release, discharge, and hold harmless CES from and against any claims, damages, disabilities, attorneys’ fees, and costs of litigation and settlement, as well as any liability due to any injuries, losses, or damages of any kind to person(s), including death, or property damage resulting, in whole or in part, directly or indirectly, from acceptance, possession, misuse, or use of any prize or participation in any activity or participation in this promotion. This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages; loss of data, income, or profit; loss or damage to property; and claims of third parties.

• Notwithstanding the foregoing, in the event that the foregoing limitation of liability is determined by a court of competent jurisdiction to be invalid or unenforceable, participants agree that CES’s liability shall be limited to the cost of entering and participating in the promotion.

• Participants further agree that CES’s liability shall be limited to the greatest extent permitted by law and that the provisions of this limitation of liability will continue in full force and effect notwithstanding any termination or cancellation of the promotion or your discontinuation of participation in the promotion.

Publicity and Privacy:

• By participating in the auction, you agree to the collection and use of your personal information for the purposes of administering the auction and notifying winners. Your information will be handled in accordance with our Privacy Policy. Except where prohibited by law, participation in the promotion constitutes Customer’s consent to CES’s and its agents’ use of the Customer’s name, likeness, photograph, opinions and/or hometown and state for promotional purposes worldwide, for a period of one year from the end of the promotion, in any and all media, manner, and formats now known or hereafter devised, without further payment or consideration.

This promotion is solely organized and sponsored by CES, an independent entity. It is not in any way sponsored, endorsed, administered by, or associated with Apple Inc., Google LLC, or any of their affiliates or subsidiaries. CES is solely responsible for all aspects of the promotion, including prize fulfillment and the management of entries. Apple Inc. and Google LLC are not affiliated with this promotion in any manner, nor do they bear any responsibility or liability for any part of it. No other partnerships or affiliations with any other company are implied or should be inferred herefrom.
